Participation Agreement and Waiver

AMATEUR: PARTICIPATION AGREEMENT, ASSUMPTION OF RISK, RELEASE OF LIABILITY AND INDEMNITY

PLEASE READ CAREFULLY. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE OR RECOVER DAMAGES IF YOU ARE INJURED. DO NOT SIGN IT UNLESS YOU HAVE READ AND UNDERSTOOD IT.

1. The parties and the activity

This agreement is between me, the undersigned participant, and The Amateur FTLS (herein known as Amateur), a Connecticut corporation with its principal place of business at 70 Main Street, New Canaan, Connecticut 06840.

In this agreement, Amateur means that company together with its owners, directors, officers, employees, contractors, volunteers, group leaders, ride and run hosts, coaches, instructors, brand partners, sponsors, affiliates, successors, landlords, and the owners and occupiers of any property used for an Activity.

Activity means any run, ride, swim, workout, training session, clinic, demonstration, group meet-up, social gathering, trip, race support, or other event organised, hosted, promoted, publicised or facilitated by Amateur, including any activity listed on an Amateur calendar, on the Amateur Strava club, or announced by Amateur on any channel, and including travel to and from any such activity.

2. Voluntary participation, and my own decisions

I am taking part voluntarily. Nobody requires me to be here. I understand that an Activity is a gathering of people exercising alongside one another, not a supervised, coached or instructed session, unless Amateur has told me in writing that a specific Activity is coached.

I remain responsible at all times for my own pace, my own route, my own effort, my own equipment, and my own decision whether to continue or stop. Any leader, host, pace-setter, marshal or member of Amateur staff present is there for company and convenience only, and I do not rely on any of them for my safety, my navigation or my health.

I have inspected, or had the opportunity to inspect, the route, the surface, the location and the weather, and I judge them suitable for me. If I do not, I will not take part.

3. Assumption of risk

I understand that endurance sport carries risks that cannot be eliminated, however carefully an Activity is organised, and that those risks include serious personal injury, permanent disability and death. I knowingly and freely assume all of them. Those risks include, and are not limited to:

  • Collision with, or injury caused by, motor vehicles, cyclists, other participants, pedestrians, animals or fixed objects;
  • Falls, slips, crashes, collisions and loss of control, including on wet, icy, loose, uneven, damaged or unlit surfaces;
  • Road, path and trail conditions of every kind, including potholes, gravel, debris, tram or rail lines, drain covers, kerbs, construction and obstructions, and the conduct of other road users;
  • Heat, cold, wind, rain, snow, ice, lightning, poor visibility, darkness and sudden changes in weather;
  • Cardiac events, stroke, respiratory events, heat illness, hypothermia, dehydration, hyponatraemia, exhaustion, fainting and other medical events brought on or worsened by exertion;
  • Strains, sprains, fractures, concussion and other head, spinal and orthopaedic injuries;
  • Equipment failure, including failure of my own or borrowed footwear, bicycle, helmet, components, wetsuit, electronics or other gear, whether or not the equipment was supplied, recommended, fitted, adjusted, demonstrated, lent or sold by Amateur;
  • The acts, omissions, negligence, inexperience or misconduct of other participants, of spectators, of members of the public and of third parties;
  • Delay, absence or inadequacy of first aid, emergency response or medical treatment;
  • Loss of, theft of or damage to my property;
  • Exposure to communicable illness.

I accept these risks whether they arise from the nature of the Activity, from the conditions on the day, from the acts or omissions of any other person, or from the negligence of Amateur.

4. My fitness and my health

I confirm that I am in sufficiently good health and physical condition to take part safely, and that I have no medical condition that makes participation unsafe for me. I have been advised to consult a physician before beginning or continuing any exercise programme, and it is my responsibility, not Amateur's, to do so.

I will stop immediately and seek help if I feel unwell, and I will not rely on anyone else to notice or to tell me to stop. Amateur has made no assessment of my fitness, my technique, my equipment or my suitability for the Activity, and owes me no duty to do so.

5. My own insurance

I confirm that I hold, and will keep in force, my own health insurance covering injury or illness arising from the Activity, and my own insurance covering damage to or loss of my own property.

I understand and agree that Amateur provides no insurance of any kind for me, and that Amateur's own insurance does not and is not intended to cover me, my injuries, my medical expenses, my lost earnings or my property. Any medical expense, ambulance charge, transport cost, equipment cost or other cost I incur in connection with the Activity is mine alone. I will not present any such cost to Amateur, and I waive any claim for reimbursement of it.

6. Rules I will follow

I will obey all traffic laws, signals and signs, and all instructions of police and emergency services. I understand I have no special right of way because I am part of a group.

I will ride or run predictably and with proper control, and will not use headphones in both ears while on open roads.

I will wear a properly fitted helmet at all times while cycling. This is a condition of participation in any Activity on a bicycle.

I will carry identification and a means of calling for help, and will provide an emergency contact.

I will make sure my own equipment is in safe working order before I start.

I will not take part while impaired by alcohol, drugs or medication.

Amateur may remove me from an Activity at any time, for any reason, without refund or explanation, and I agree that if I am asked to leave I will do so.

7. Release and waiver of claims, including claims of negligence

In consideration of being permitted to take part, I, for myself, my spouse, my children, my heirs, my executors and administrators, my personal representatives and my assigns, release, waive, discharge and agree not to sue Amateur from and in respect of any and all claims, demands, actions, causes of action, liabilities, losses, damages, costs and expenses of every kind, whether known or unknown, and whether arising in contract, in tort, by statute or otherwise, for injury to me, for my death, for illness, or for loss of or damage to my property, arising out of or in any way connected with my participation in any Activity, my presence at any location used for an Activity, or my travel to or from any Activity.

This release applies to claims arising from the negligence of Amateur, whether that negligence is active or passive, and whether it consists of an act or of a failure to act. It also applies to claims arising from the condition of any premises, route or equipment, from the selection or conduct of any route, from the supervision or lack of supervision of any Activity, and from the acts or omissions of any other participant.

This release does not apply to, and nothing in this agreement is intended to release, conduct that is reckless, wilful, wanton or intentional, or any liability that cannot be released as a matter of Connecticut law.

8. Indemnity

I will indemnify, defend and hold Amateur harmless from and against any claim, liability, loss, damage, cost or expense, including reasonable attorneys' fees, brought by or on behalf of any person, including a member of my family, arising out of or connected with my participation in an Activity, my own acts or omissions, or my breach of this agreement.

9. Medical treatment

If I am injured or become unwell, I consent to Amateur, or anyone acting on its behalf, arranging first aid, ambulance transport or emergency medical treatment for me. That is a convenience to me, not an undertaking by Amateur to provide, procure or pay for care, and I am responsible for the cost of any treatment or transport.

10. No warranty on product, advice or equipment

Any advice, recommendation, fitting, gait analysis, demonstration, loan of equipment or opinion given by Amateur or any partner at or in connection with an Activity is given as general information for my consideration. It is descriptive, not prescriptive. It is not medical, coaching, physiotherapy or safety advice, and I am responsible for my own decisions about what to use and how.

Product lent or demonstrated at an Activity is used at my own risk. I will return it in the condition I received it and I am responsible for loss of or damage to it. This section does not affect any manufacturer warranty or any right I have under consumer protection law in respect of goods I buy.

11. Third parties

Some Activities are run with brand partners, clubs, coaches, venues and other third parties. I understand that Amateur does not control those parties and is not responsible for their acts or omissions, and that each of them is included in the definition of Amateur for the purposes of sections 3, 7 and 8.

12. Data

I consent to Amateur holding the contact, emergency contact and participation details I give, and using them to run the Activity, to contact me about it, and to keep a record of attendance. Amateur's privacy policy at amateur.cc applies.

13. Governing law and jurisdiction

This agreement is governed by the laws of the State of Connecticut, without regard to its conflict of laws rules. I agree that any dispute arising out of or connected with it, or with any Activity, will be brought only in the state or federal courts sitting in Fairfield County, Connecticut, and I submit to the jurisdiction of those courts.

14. Severability and entire agreement

Each section of this agreement stands on its own. If any provision, or any part of a provision, is held to be unenforceable, it is to be severed or read down to the extent necessary, and the remainder of the agreement, including in particular my assumption of risk in section 3 and my representations in sections 4 and 5, remains in full force. This agreement is the entire agreement between me and Amateur about the subject matter, and replaces anything said or written beforehand.

15. Acknowledgment

I have read this agreement in full. I understand it. I understand that by signing it I am giving up substantial legal rights, including the right to sue Amateur for its own negligence. I am signing it freely, without inducement or pressure, and I have had the opportunity to ask questions and to take legal advice. I am 18 years of age or older, or a parent or guardian is signing the addendum below on my behalf.

Images and film

Amateur photographs and films its events, and I agree that Amateur may record my image, likeness and voice at an Activity and use those recordings, without payment and without further approval, in Amateur's own marketing, editorial, social channels, website and archive, and in materials produced with its brand partners in connection with the Activity. I waive any right to inspect or approve the finished use. If I ask Amateur in writing to stop using a recording of me, Amateur will stop using it in new material as soon as it reasonably can, and is not required to recall or amend material already published.
